OK, I understand below I-40 you can have a bee yard with 25 or less hives before you are considered commercial. Can anyone answer me whether it is 25 hives total or 25 in one spot? What if a person has 15 in one yard and another 15 in a different location, or more? Is it still hobbyist or commercial?

I emailed Greg Watson about this and he wasn't very clear about it.

 Les discussed this briefly in our seminar but I do not remember the details. I think that the law was meant to discourage bee yard wars. I am sure that you could email him and ask, he is the former inspector. Or the wonderful Jessie Brown might know?

I heard that before about the bee yard wars. My current understanding, which may be flawed, is that you can have up to 25 in one spot. I believe you can have multiple spots, but not sure. Above 1-40, it is 10 or so, I think. After that, you must register and get the Bee Inspector to come and check you out.

Goodness Paul, how many beehives do you have down there?! That's going to be quite the site seeing you haul hundreds of beehives up to Santa Fe for your first day of work!

"commercial apiary" means any location or single beeyard North of I-40 where 15 or more colonies are located or South of I-40 where 25 or more colonies are located. So, you can have 10 in one yard, and another 10 in another yard, 10 in a third yard and not have to pay the fee or be considered commercial. 

If you qualify as a "commercial apiary" you have to register your apiary and pay an annual registration fee that runs $3 per apiary per year. This amount can be paid through Greg Watson, Assistant Bureau Chief, NM Dept of Agriculture, NMDA inspector for NM. He can be contacted at gwatson@nmda.nmsu.edu or (505) 646-3207

If you are a "commercial apiary" you need to obtain a pollination permit to move bees for pollination purposes within 1 1/2 miles of another beekeeper's registered apiary.
